The Short Version
1. Agreement to These Terms
These Terms of Service (the "Terms") are a binding agreement between you and Apparent Logic, LLC ("Apparent Logic," "we," "us," or "our") governing your use of the Check ID mobile application, the Check ID for Teams service and web console, and the checkidapp.com website (together, the "Service").
By downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
If you use the Service on behalf of a business or other organization (for example, by setting up Check ID for Teams), you represent that you are authorized to bind that organization, and "you" refers to that organization.
2. Definitions
- "App" — the Check ID mobile application for iPhone, iPad, and other supported Apple platforms.
- "Check ID for Teams" (or "Teams") — our paid subscription service for businesses, including shared devices, staff accounts, compliance reporting, and cloud sync ("Check ID Cloud").
- "Account" — the account you create to access paid or team features.
- "Customer Data" — the data your organization enters or generates through the Service, such as team members, guest lists, scan events, and audit logs.
- "Subscription" — a recurring paid plan (for example, Check ID Pro or a Check ID for Teams tier).
3. Eligibility & Accounts
You must be at least 18 years old and able to form a binding contract to use paid features or create an Account. The Service is intended for business and professional use in verifying the age or identity of other people at a point of entry or sale.
Check ID for Teams uses passwordless sign-in (such as passkeys, Sign in with Apple, or a one-time email link). You are responsible for keeping your sign-in methods and devices secure, for the accuracy of the information you provide, and for all activity that occurs under your Account. Notify us promptly at support@checkidapp.com if you believe your Account has been compromised.
4. The Service & Plans
Check ID scans and verifies physical IDs, mobile driver's licenses, and ePassports to help you confirm a person's age or identity. We offer:
- Check ID (Free) — on-device scanning with usage limits.
- Check ID Pro — a one-time purchase that unlocks unlimited personal use on your device.
- Check ID for Teams — paid business subscriptions with multi-staff, shared-device, reporting, and cloud features, offered as single-venue and multi-location/enterprise tiers.
Check ID for Teams can flag when the same physical ID is scanned again within a short window ("pass-back detection"). Digital wallet IDs (mobile driver's licenses presented from Apple Wallet) are verified cryptographically at presentation but do not participate in pass-back detection, since a wallet credential is bound to its holder's device and that device's biometrics.
We may add, change, or discontinue features, plans, or the Service itself. If we make a material adverse change to a paid plan you are actively subscribed to, we will provide reasonable notice.
5. Billing, Renewal & Price Changes
Paid plans are billed through the payment method used to buy them:
- App Store purchases (Check ID Pro and in-app subscriptions) are processed and billed by Apple under your Apple Account, and are subject to Apple's terms. Subscriptions bought through the App Store auto-renew unless you turn off renewal in your Apple subscription settings at least 24 hours before the period ends.
- Web/business purchases made through our web console are processed and billed by Stripe. These subscriptions auto-renew each billing period until cancelled. For invoiced plans, payment is due per the terms on the invoice (for example, net 30). You authorize us and Stripe to charge your payment method on file for recurring fees, applicable taxes, and any per-venue or usage amounts for your plan.
Fees are stated exclusive of taxes; you are responsible for applicable sales, use, VAT, or similar taxes. We may change prices for a Subscription; changes take effect at your next renewal, and for web/business plans we will give reasonable advance notice. Continuing to use a paid plan after a price change takes effect means you accept the new price.
6. Free Trials
We may offer a free trial for certain plans. Unless you cancel before the trial ends, the plan converts to a paid Subscription and your payment method is charged at the then-current price. Trial eligibility and length are determined by us (and, for App Store trials, by Apple). We may modify or withdraw a trial offer at any time.
7. Cancellation & Refunds
You can cancel a Subscription at any time:
- App Store subscriptions: manage or cancel in your Apple subscription settings. Refunds for App Store purchases are handled by Apple under its policies; we cannot issue them directly.
- Web/business subscriptions: cancel from the billing portal in your web console, or contact us. Cancellation stops future renewals; access continues through the end of the paid period.
Except where required by law or expressly stated otherwise, payments are non-refundable and we do not provide refunds or credits for partial periods, unused time, or features not used. Check ID Pro is a one-time purchase and is non-refundable except as required by the App Store or applicable law.
8. License & Restrictions
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business or personal ID-verification purposes. You must not:
- copy, modify, reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent this restriction is prohibited by law;
- resell, sublicense, rent, or provide the Service to third parties as a service bureau, except as expressly permitted for your own staff under a Teams plan;
- circumvent usage limits, security, or access controls, or share paid access outside your licensed Account, venue, or device count;
- use the Service to build a competing product, or use automated means to scrape or overload the Service.
9. Acceptable Use
You agree not to use the Service to:
- violate any law, regulation, or third-party right;
- collect, store, or use information from a scanned ID for any purpose other than verifying age or identity, or in any way that violates applicable ID-scanning, privacy, or data-retention laws;
- harass, discriminate against, profile, or unlawfully deny service to any person;
- upload unlawful, infringing, or harmful content to guest lists, notes, or other fields; or
- interfere with, disrupt, or attempt to gain unauthorized access to the Service or its infrastructure.
10. Your Compliance Responsibilities
Check ID is a tool to assist your own verification decisions. It is not legal advice, and we are not your lawyer or compliance advisor.
Laws governing ID checking, scanning, data handling, and age-restricted sales vary by jurisdiction and change over time. You are solely responsible for determining which laws apply to your business, configuring and using the Service accordingly, training your staff, and making the final decision to admit, serve, or refuse any person. Where the Service offers jurisdiction-based settings (for example, enabling or disabling pass-back detection by location), you are responsible for choosing the settings appropriate for your venues.
For Customer Data your organization processes through Check ID for Teams, your organization is the data controller and Apparent Logic acts as a processor on your behalf, as described in our Privacy Policy; if your organization needs a data processing agreement, contact us.
11. Customer Data & Privacy
As between you and us, you own your Customer Data. You grant us a limited license to host, process, and transmit it solely to provide, secure, and improve the Service and as described in the Privacy Policy. You represent that you have the rights and any required notices or consents to provide the data you enter into the Service.
Our handling of data is described in the Privacy Policy. In short: we do not keep the name, date of birth, address, ID number or photo read from a scanned ID. Check ID for Teams scan records keep a few facts about the document, such as the age in whole years and the issuing state, and a one-way cryptographic pass-back code, built so a breach of our servers alone can't be turned into a list of your patrons, is deleted after the repeat-entry window. The Privacy Policy lists everything that is kept.
12. Intellectual Property
The Service, including its software, design, and the "Check ID" name and logo, is owned by Apparent Logic and protected by intellectual-property laws. Except for the limited license in these Terms, we grant you no rights in the Service. Any feedback you send us may be used without restriction or obligation to you.
13. Third-Party Services & Platforms
The Service relies on third parties, including Apple (App Store and device platform), Stripe (web/business payments), and our hosting and email providers. Your use of those services is subject to their terms, and we are not responsible for them. If you obtained the App through the App Store, you acknowledge that these Terms are between you and Apparent Logic, not Apple, and that Apple is not responsible for the App or its support.
14. Beta & Pre-Release Features
We may offer features labeled beta, preview, or early access. These are provided "as is," may change or be withdrawn, and may be less reliable than generally available features. We have no liability arising from your use of beta features.
15. Disclaimers
No ID-verification method is perfect. The Service may not detect every fraudulent, altered, borrowed, or expired ID, and it does not guarantee that any person is who or the age they claim to be. Using the Service does not by itself establish a legal defense (such as an affirmative defense to a sale-to-a-minor charge); whether any defense applies depends on the law and facts of your situation.
The Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that it will meet your requirements or achieve any particular compliance outcome. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
16. Limitation of Liability
To the fullest extent permitted by law, Apparent Logic and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business, arising out of or relating to the Service or these Terms, even if advised of the possibility. This includes, without limitation, any regulatory fine, penalty, or liability you incur, or any loss from admitting or refusing a person, whether or not the Service functioned as intended.
Our total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or (b) US $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
17. Indemnification
You will defend, indemnify, and hold harmless Apparent Logic from and against any claims, damages, liabilities, and costs (including reasonable legal fees) arising out of your use of the Service, your Customer Data, your violation of these Terms or applicable law, or your verification decisions.
18. Suspension & Termination
You may stop using the Service at any time and cancel any Subscription as described in Section 7. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to others, the Service, or us, or as required by law. On termination, your license ends and we may delete Customer Data after a reasonable period, subject to the retention described in the Privacy Policy. Sections that by their nature should survive (including Sections 8, 11–12 and 15–21) survive termination.
19. Governing Law, Arbitration & Dispute Resolution
Governing law. These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules and excluding the U.N. Convention on Contracts for the International Sale of Goods.
Informal resolution first. Before starting an arbitration or filing a claim, you agree to contact us at support@checkidapp.com and give us at least 30 days to resolve the dispute informally and in good faith.
PLEASE READ — THIS SECTION AFFECTS YOUR LEGAL RIGHTS. You and Apparent Logic agree that any dispute will be resolved by binding individual arbitration rather than in court, and that each party waives the right to a jury trial and to bring or participate in any class or representative action.
Agreement to arbitrate. Except for the matters described under “Exceptions” below, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules or, for business-to-business disputes, its Commercial Arbitration Rules, as applicable. This agreement to arbitrate is governed by the Federal Arbitration Act. The arbitration will be held in the county of your residence or principal place of business, or by videoconference or telephone, unless you and we agree otherwise, and judgment on the award may be entered in any court of competent jurisdiction.
Class-action waiver. All disputes will be arbitrated only on an individual basis. Neither you nor Apparent Logic may bring or participate in a class, collective, consolidated, or representative action, and the arbitrator may not consolidate more than one person’s claims or preside over any representative or class proceeding. If this class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will be severed and decided in court.
Exceptions. Either party may (a) bring an individual claim in small-claims court if it qualifies, and (b) seek injunctive or other equitable relief in court to protect its intellectual property or confidential information. For any dispute that is not subject to arbitration, the exclusive venue is the state and federal courts located in California, and you consent to their personal jurisdiction.
30-day opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@checkidapp.com with your name and a statement that you opt out of arbitration. Opting out will not affect any other part of these Terms.
20. Changes to These Terms
We may update these Terms from time to time. When we make changes, we will update the "Last Updated" date above and, for material changes, provide reasonable notice (for example, in the App or by email). Your continued use of the Service after changes take effect means you accept the updated Terms.
21. General
These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service and supersede prior agreements on that subject. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control. Notices to you may be provided in the App, on this website, or by email; notices to us should go to the address in Section 22.
